We at ShiftLeft, Inc. d/b/a Qwiet AI (“Qwiet AI,” “we,” or ”us”) take your privacy seriously. Please read this Privacy Policy to learn about the information we collect when you access or use our website or related services (collectively, the “Services”), and how we may use, share, and protect such information. By using or accessing our Services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), “information” means any information relating to an identified or identifiable individual.

Generally, we collect information about you in four main ways: (1) information you provide to us; (2) log-in credentials and related information; (3) information from cookies and similar technologies; and (4) information we receive from third parties.

Information You Provide. We collect information that you provide to us. For example, we may collect information from you through the registration process and through your account settings, when you fill out a form, make a purchase, request customer support, or when you participate in any interactive features of our Services. Such information may include, but is not limited to, your name, username, email address, and phone number.

Log In Credentials & Third-Party Account Information. We will also collect information when you create an account using your GitHub (or other third-party) log-in credentials. If you sign in to the Services through a third-party account, such as GitHub, you understand and agree that we collect information associated with your third-party account.

Communications. If you contact us directly, we may receive additional information about you. For example, if you contact us for customer support, we may receive your name, email address, phone number, the contents of the message and any attachments you send to us, and any other information you choose to provide. If you subscribe to our newsletter, we will collect certain information from you, such as your email address. We may also receive your Slack username and other information when you request assistance through our Slack channel.

Careers. If you decide that you wish to apply for a job with us, you may submit your contact information and your resume online. We will collect the information you choose to provide on your resume, such as your education and employment experience. You may also apply through LinkedIn. If you do so, we will collect the information you make available to us on LinkedIn.

Information from Cookies and Similar Technologies. Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device, which may include, but is not limited to, your IP address, site/product usage data, machine data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features of our Services are visited and by how many people. Provide & Improve Services. When you register for a member account, we use the information you provide to create and maintain your account. The information we collect also helps us improve and enhance our Services.

Customize Content. We may use information we collect to customize content that we share with you and to provide you with information that may be of interest to you.

Communications. We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email offers or email you about your use of the Services. Also, we may receive confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our Services. If you do not want to receive communications from us, please indicate your preference by opting out via the links provided in the emails. Note that if you opt-out of receiving our marketing emails, you may still receive transactional emails from us.

De-Identified Information

We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Services.

Affiliated Businesses. In certain situations, businesses or third-party websites we’re affiliated with may sell or provide products or services to you through or in connection with our Services (either alone or jointly with us). We have no control over the policies and practices of third-party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such businesses’ or websites’ policies.

Vendors & Service Providers. We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you; for example, we may use a payment processing company to receive and process your credit card transactions for us.

Analytics Partners. We use analytics services to collect and process certain analytics data. These services may also collect information about your use of other websites, apps, and online resources.

Advertising Partners. We work with third-party advertising partners to show you ads that we think may interest you. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info). If you do not wish to receive personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving web-based personalized ads from member companies. You can access any settings offered by your mobile operating system to limit ad tracking, or you can install the AppChoices mobile app to learn more about how you may opt out of personalized ads in mobile apps.

Business Transfers. We may choose to buy or sell assets and may share and/or transfer your information in connection with the evaluation of and entry into such transactions. Also, if our company (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, your information could be one of the assets transferred to or acquired by a third party.

Protection of Qwiet AI & Others. We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our Terms of Service (https://qwiet.ai/terms-of-service) and other agreements; or protect the rights, property, or safety of Qwiet AI, our employees, our users, or others. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.

Consent. We may also disclose your information with your permission.

Do Not Track

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Although we may do so in the future, our website does not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the website and after you leave our website.

You may request access to the information we maintain about you, update and correct inaccuracies in your information, restrict or object to the processing of your information, have your information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your information to another company. You may withdraw any consent you previously provided to us regarding the processing of your information at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.

Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

Security

We make reasonable efforts to protect your information by using safeguards designed to improve the security of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.

Retention

We take measures to delete your information or keep it in a form that does not permit identifying you when your information is no longer necessary for the purposes for which we process it unless we are required by law to keep your information for a longer period. When determining the specific retention period, we consider various factors, such as the type of service provided to you, the nature and length of our relationship with you, and mandatory retention periods provided by law and the statute of limitations.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of certain information to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at [email protected]. Transborder Transfer

Our Services are hosted in the United States. If you choose to use our Services from the EEA, the UK or other regions of the world with laws governing data collection and use that may differ from United States law, then please note that you are transferring your information outside of those regions to the United States for storage and processing. We may transfer information from the EEA or the UK to the United States and other third countries based on European Commission-approved Standard Contractual Clauses, as needed to perform our Services that you have requested from us, or with your consent. By providing information to us, you consent to the transfer of your information to the United States and the use of it in accordance with this Privacy Policy.

Policy Updates

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share information previously collected from you through the Services, we will notify you through the Services, by email, or other communication.

Children

We do not knowingly collect or solicit information from anyone under the age of 13. If you are under 13, please do not attempt to register for our website or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.
